1. Agreement to Terms

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL MEET YOUR REQUIREMENTS
• THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• THE RESULTS OF USING THE SERVICE WILL BE ACCURATE, RELIABLE, OR MEET YOUR EXPECTATIONS
• ANY ERRORS IN THE SERVICE WILL BE CORRECTED
• THE SERVICE WILL SUCCESSFULLY RECOVER YOUR FILES OR RECOVER THEM COMPLETELY

7. Limitation of Liability

IN NO EVENT SHALL RECOVERTHISFILE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, VENDORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA LOSS, BUSINESS INTERRUPTION, OR ANY OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICE, EVEN IF RECOVERTHISFILE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF:

1. THE AMOUNT PAID BY YOU TO RECOVERTHISFILE FOR THE SERVICE DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY, OR
2. $100 USD.

8. Payment Terms

Certain aspects of the Service may require payment. By choosing a paid subscription or service:

• You agree to pay all fees in accordance with the pricing and payment terms presented to you
• You authorize us to charge your designated payment method for these fees
• You must provide current, complete, and accurate billing information
• We may suspend or terminate your access if payment is not received

8.1 Subscription Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel a subscription at any time, but no refunds will be provided for the current billing period.

8.2 Price Changes

We reserve the right to adjust pricing for our Service or any components thereof in any manner and at any time as we may determine in our sole discretion. We will provide at least 30 days' notice of any price changes to active subscribers.

9. Term and Termination

These Terms will remain in full force and effect while you use the Service. We may suspend or terminate your access to the Service, without notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• Any ongoing subscriptions will be cancelled
• Sections of these Terms that, by their nature, should survive termination shall survive termination

10. General Provisions

10.1 Governing Law

These Terms shall be governed by the laws of the State of California, without respect to its conflict of laws principles.

10.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively through binding arbitration in San Francisco, California, except that you may bring claims in small claims court if they qualify.

10.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions will continue in full force and effect.

10.4 Entire Agreement

These Terms constitute the entire agreement between you and RecoverThisFile regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.
